Mike Brothers Emblematic Solutions LLC is committed to producing and distributing products that are compliant with applicable Product Safety standards established by the Consumer Products Safety Administration (CPSA). Our products utilize many different components and raw materials including copper, brass, iron, zinc alloy, enamels, epoxy, cotton, acetate, nylon, polyester, plastisol inks, PVC (poly vinyl chloride), paper, scents, lead crystal, and batteries.
To achieve the appearance and effect desired by our customers at effective price points, it is necessary to utilize materials that contain small amounts of chemicals and elements that appear on the list of materials that are restricted to levels considered safe by the CPSA. These materials include nickel, phthalates and lead.
Our factory purchases raw materials in large quantities and all raw materials are tested upon request in accordance with ASTM guidelines established by the CPSA. Due to the nature of our highly customized product, the fact that end users for our products are commonly adults and the relatively small size of most individual orders it is not economically feasible to comply with the more stringent CPSIA standard at published prices.
CPSIA standards apply to products intended for distribution to consumers under the age of 13 years. Mike Brothers Emblematic Solutions LLC can provide products for these applications. In order to comply with the more stringent CPSIA standards, the materials we use must utilize are more costly. In addition, utilization of restricted manufacturing techniques to ensure no contamination by contact with ambient nickel, lead and phthalates that may be present on equipment and in manufacturing, environment is required. It is also necessary to re-test the completed product and its component parts to ensure compliance with the CPSIA standard if the product is intended for distribution to an audience under the age of 13 years.
For the protection of both Mike Brothers Emblematic Solutions LLC and our Distributors we require that we be notified at the time of quotation to the end user if the product is intended for distribution to consumers covered by the CPSIA. We will then provide a custom quotation for these applications. Different from our published prices for these applications will include an increase in the unit cost as well as costs for the required Product Safety testing. These additional costs will be invoiced to our Distributors on a per order basis. This way safe products will comply with the request of our Distributors and their end user customers, avoiding exposure to Product Safety liabilities.
For products intended for distribution within the state of California, Mike Brothers Emblematic Solutions LLC provides packaging printed with a warning intended to protect our Distributors from exposure to Proposition 65 liability. The alternative packaging is provided as a no-cost option and must be requested at the time of order placement.
California Proposition 65 Statement
All products shipped by Mike Brothers Emblematic Solutions LLC into the State of California are subject to Proposition 65 (“Prop 65”) or The Safe Drinking Water and Toxic Enforcement Act of 1986. "Prop 65" was created through the ballot initiative process and was intended to protect California citizens and the State’s drinking water from a State determined list of over 900 chemicals that are “known” by the State to cause cancer, reproductive harm, or birth defects. This list and other information regarding Prop 65 can be accessed at https://www.oehha.ca.gov/prop65.
Prop 65 requires that a “clear and reasonable warning” be provided by a Person/Company in the course of doing business, who manufactures, produces, assembles, processes, handles, distributes, stores, sells, or otherwise transfers a consumer product which he or she knows to contain a chemical known to the state to cause cancer or reproductive toxicity to any person to whom the product is sold or transferred.
Mike Brothers Emblematic Solutions LLC is fully committed to providing the highest quality, safest products for our clients and all Mike Brothers Emblematic Solutions LLC products meet applicable federal safety and warning requirements, standards and regulations as enforced by the Consumer Product Safety Commission, the U.S. Food and Drug Administration, and the Federal Communications Commission.
Upon request Mike Brothers Emblematic Solutions LLC will use third-party laboratories to test raw materials and finished products to ensure products meet these standards.
However, due to the custom nature of our product line and the wide variety of product components available on our custom-made products, it is not practical to test every piece and component of every order for each of the 900 chemicals covered by Proposition 65.
For the protection of both Mike Brothers Emblematic Solutions LLC and our Distributors, Mike Brothers Emblematic Solutions LLC has decided to exercise an abundance of caution and has proactively identified a list of products that require a warning label when shipping to the state of California.
The following short form warning label will be applied to master bag product packaging for each product from the list below that ships to the State of California after August 30, 2018. The label will appear as follows and will ensure compliance with California Proposition 65 requirements:
For orders not shipping to California, Mike Brothers Emblematic Solutions LLC offers this label free of charge upon request. This option must be requested at the time of order placement.
Additionally, third party testing is available on every order and may be quoted upon request.
